Terms and Conditions of Sale and Use of the website pokejap.com. By accessing, browsing or purchasing on the website, the user fully accepts these Terms. The Seller may update them at any time with ten (10) days' notice on the website; users are invited to check this page periodically.
1. Definitions
Seller: POKEJAP LTD, registered office at Strovolou 77, Strovolos Center, Office 301, 2018 Strovolos, Nicosia, Cyprus – TIN 60199590T – email info@pokejap.com, WhatsApp +39 348 4260292.
Customer: any individual or legal entity purchasing products on the website, whether Consumer (a natural person acting for purposes unrelated to a professional activity) or Professional (a natural or legal person purchasing with a VAT number). User: any person accessing the website. Products: Japanese-language Pokémon trading cards and sealed products sold on the website. Order: a purchase proposal submitted by the Customer through the shopping cart.
2. Subject of the contract
These Terms govern the distance sale of Products between the Seller and the Customer through the website. The online sale is governed by European consumer legislation, including Directive 2011/83/EU (consumer rights) and Directive 2000/31/EC (e-commerce), together with the national laws applicable in the Consumer's country of residence. The online store is hosted on Wix.com, which provides the technology for e-commerce and data management.
3. Product description
Products are described on each product page with name, set, card number, rarity, illustrator where known, condition and photo. Single cards are sold in Mint condition (PSA 9 standard or better, as described on the Info page); graded cards are sold in their original PSA or BGS slab with the grade stated in the listing. Cards are original and in Japanese language. Photos are representative; minor differences in colour rendering due to screens do not constitute a defect.
4. Prices and additional costs
All prices are in euro and include applicable VAT. The shopping cart shows the product price and the shipping cost. Prices may change without notice, but the amount charged is the one published at the time of the Order. The Seller ships only within the European Union: no customs duties or import taxes apply.
5. User registration
Registration is optional and allows the Customer to follow orders more easily. The user is responsible for the accuracy of the data provided. Personal data is processed in compliance with Regulation (EU) 2016/679 (GDPR) and used exclusively for purposes related to the purchase or, with prior consent, for promotional communications.
6. Purchase procedure and order limits
Purchases are made by adding Products to the shopping cart and completing the checkout. The contract is concluded when the Seller confirms the Order by email. The Seller may refuse incomplete or incorrect orders, or orders for Products that are no longer available, refunding any amount paid.
To give every collector a fair chance, each Order may contain at most two (2) copies of the same card, whether available or on pre-order. The Customer may cancel an Order before dispatch by contacting the Seller by email or WhatsApp.
7. Pre-orders
Products marked Pre-order are temporarily out of stock and being restocked. They are paid at checkout and shipped within twenty (20) working days from the Order, usually sooner. If an Order contains both available and pre-order Products, the whole Order ships in one parcel once all Products are in stock, within the same twenty working days. Should a pre-ordered Product become unobtainable, the Seller refunds it in full.
8. Payment methods
Accepted payment methods: credit and debit cards (Visa, Mastercard, American Express), Apple Pay and Google Pay. Payments are processed by Stripe on a secure, encrypted platform; the Seller never receives the Customer's card details. The amount is charged when the Order is placed.
9. Shipping and delivery
Deliveries are made by tracked express couriers, Monday to Friday, excluding public holidays. Orders are dispatched the working day after the Order (pre-orders: see article 7). Shipping costs: Italy €5 per Order, European Union €10 per Order.
Estimated delivery times: 2-4 working days for Italy, 3-5 working days for the rest of the European Union. Times are indicative and not essential; any delay is communicated to the Customer by email. If the delay exceeds thirty (30) days, the Customer is entitled to a full refund.
The Customer is responsible for the accuracy of the shipping address; additional costs for failed deliveries due to incorrect data are borne by the Customer. Damages or discrepancies must be documented with photos and reported to the Seller as soon as possible. Loss or damage caused by the courier is handled by the Seller with a replacement or a full refund.
10. Right of withdrawal
Consumers may withdraw from the purchase, without giving reasons, within fourteen (14) days of delivery by notifying the Seller by email or WhatsApp. After the notice the Seller sends the Customer a return shipping label by email; the Products must be returned within fourteen (14) days, in the same condition and original packaging in which they were delivered (sleeve, toploader, sealed slab or sealed box). The return label is provided by the Seller free of charge. Refunds are issued within fourteen (14) days of receipt of the returned Products, after checking their integrity, using the same payment method.
The right of withdrawal does not apply to Products damaged or altered after delivery, to sealed Products (booster boxes, graded slabs) whose seal has been broken, and to purchases made by Professionals. Full details are on the Returns and Refunds page.
11. Legal warranty
Consumers benefit from the legal warranty of conformity provided by EU law (24 months) for Products that do not correspond to the description. Professionals are entitled to the warranty provided by the applicable civil law. Claims must be accompanied by proof of purchase and, where possible, by photos of the Product.
12. Force majeure
The Seller is not liable for delays or failures due to force majeure, including natural disasters, disruptions of digital or logistics services, pandemics or government actions.
13. Intellectual property
All website content, including trademarks, graphics and texts, is the property of the Seller or of its legitimate owners (Pokémon and related names are trademarks of their respective owners) and may not be used without prior written authorisation.
14. Privacy
The processing of personal data complies with the GDPR and is detailed in the Privacy Policy and Cookie Policy available on the website.
15. Applicable law and jurisdiction
For Consumers, the competent court is that of the Consumer's place of residence; mandatory consumer protection rules of the Consumer's country apply. For Professionals, disputes are subject to the exclusive jurisdiction of the courts of Nicosia, Cyprus. Consumers may also use the European Union online dispute resolution (ODR) platform.
