Terms and Conditions of Sale and Use of the Website

Preamble

These Terms and Conditions govern the sale of products available on the website pokejap.com and regulate its use.
By accessing, browsing, and using the website, the user fully and unconditionally accepts these Terms and Conditions.

The Seller reserves the right to make changes, additions, or updates to these Terms and Conditions without prior notice, except by publishing a notice on the website for at least ten (10) days following the modification. Users are invited to check this section periodically for updates.

The online sale of products offered on the site is governed by European legislation on e-commerce, consumer protection, and distance contracts, including Directive 2011/83/EU (consumer rights) and Directive 2000/31/EC (e-commerce), in addition to the national laws applicable in the consumer’s country of residence.

The online store is hosted on Wix.com, which provides the technology required for e-commerce and data management.

Article 1 - Definitions

  • Customer: Any individual or legal entity purchasing products from the website, whether Consumer (a natural person acting for purposes unrelated to their professional or business activity) or Professional (a natural or legal person purchasing with VAT number).

  • User: Any person accessing, browsing, or using the website, regardless of registration.

  • Products: Trading cards and collectible items, mainly from Japan, sold through e-commerce.

  • Order: A purchase proposal submitted by the user through the website’s shopping cart.

  • E-commerce: A commercial modality where contracts are concluded remotely via digital services.

Article 2 - Subject of the Contract

These Terms and Conditions govern the purchase of Products and the use of the website. Any clause declared null or ineffective shall not affect the validity of the other provisions.

Article 3 - Product Description

Products are described in their respective information sheets available on the website. Images are for illustrative purposes only and may not exactly match the actual product. Minor discrepancies shall not constitute grounds for complaint or contract termination, unless they are significant.
In the event of temporarily unavailable products, the Customer will be promptly informed and may choose to wait, modify the order, or request a full refund.

Article 4 - Prices and Additional Costs

All prices are expressed in euros and include applicable taxes.
The shopping cart details:

  • Product price;

  • Shipping costs, if any.

Prices may change without notice, but the amount charged to the Customer will correspond to that published at the time of the Order.
For purchases made from EU countries, any customs duties or local taxes shall be borne by the Customer.

Article 5 - User Registration

Registration is optional but recommended to benefit from the website’s services. The user is responsible for the accuracy and update of the information provided.
Personal data is processed in compliance with Regulation (EU) 2016/679 (GDPR) and used exclusively for purposes related to the purchase or, with prior consent, for promotional purposes.

Article 6 - Purchase Procedure

Purchases are made by following the instructions on the website, adding products to the shopping cart, and selecting payment and delivery methods.
The contract is considered concluded when the Seller confirms the Order by email.
The Seller reserves the right to refuse incomplete, incorrect, or unavailable product orders.
The Customer may cancel the Order before shipment by contacting the Seller via email or WhatsApp.

Article 7 - Payment Methods

Accepted payment methods include:

  • Stripe (credit and prepaid cards via secure platform)

  • PayPal (SSL-encrypted secure transactions)

  • Bank transfer (details provided at checkout)

  • Cash on delivery (available only in certain countries, subject to Seller’s confirmation)

  • Other methods (the Seller may update available options on the website).

Article 8 - Shipping and Delivery

Deliveries are handled by specialized couriers Monday to Friday, excluding holidays.
Estimated delivery times:

  • 2–5 business days for tracked shipments within Italy

  • 5–20 business days for standard shipments

  • 5–10 business days for EU shipments

Any damages or discrepancies must be documented with photos and reported to the Seller.
The Customer is responsible for the accuracy of the shipping address. Additional costs for failed deliveries due to incorrect information shall be borne by the Customer.
In case of delays exceeding 30 days, the Customer is entitled to a full refund of the amounts paid.

Article 9 - Right of Withdrawal

Consumers may exercise the right of withdrawal within 14 days of delivery by notifying the Seller via email or WhatsApp.
The goods must be returned intact, in their original packaging, and at the Customer’s expense.
Exclusions from withdrawal:

  • Used or damaged products

  • Customized or sealed items with the seal broken

Refunds will be processed within 14 days of receipt of the returned goods, subject to their integrity.
The right of withdrawal does not apply to Professionals (purchases with VAT number).

Article 10 - Legal Warranty

Consumers benefit from a 24-month legal warranty for non-compliant products.
Professionals are entitled to the warranty provided under the Civil Code.
Reports must be submitted within the prescribed period and accompanied by proof of purchase.

Article 11 - Force Majeure

The Seller is not liable for delays or failures due to force majeure, including natural disasters, digital or logistics service disruptions, pandemics, or government actions.

Article 12 - Intellectual Property

All website content, including trademarks, graphics, and texts, is the exclusive property of the Seller and may not be used without prior written authorization.

Article 13 - Privacy

The processing of personal data complies with GDPR and is detailed in the Privacy Policy and Cookie Policy available on the website.

Article 14 - Applicable Law and Jurisdiction

For Consumers, the competent court is that of the Customer’s place of residence.
For Professionals, disputes are subject to the exclusive jurisdiction of the courts of Nicosia, Cyprus.

Article 15 - Dispute Resolution

Consumers may access the European Union’s ODR platform for online dispute resolution.
